Prominent attorney Philip J. Berg filed a writ to stay the election on the grounds that Obama did not qualify as a candidate. Justice Souter denied the stay, and the election has commenced.

The Writ, however, was NOT dismissed by the court, and the defendants will have to answer the charges by Dec 1st.

Justice Souter's Clerk has informed Mr. Berg that Mr. Berg's application for an injunction to stay the November 4th election has been denied. (The U. S. Supreme Court Docket is below.)

The defendants are required to respond to the Writ of Certiorari by December first, after which Mr. Berg will have an opportunity to respond.

The writ is to overturn the previous denial of the 3rd circuit to hear this case based on the notion that Berg has no legal "standing" to pursue it.

Also from Berg's site:
"A writ of certiorari, if granted, is not a disposition of the case. It is simply the Supreme Court agreeing to hear the issue at some future date. If they deny the writ... it's over. If they grant the writ, it hasn't even started. Then arguments will eventually have to be made before the court. "

So if the court grants this writ, the court will have to hear Berg's arguments that Obama is not qualified under the constitution, as he was not born on US soil, and has never actually attained US citizenship in any event.

Berg alleges that Obama's official birth certificate from a hospital in Hawaii has never been produced, because it does not exist. In response to his challenge the DNC evidently posted up a "Certificate of Live Birth" on the web, but the serial number on that document was obliterated (possibly to preclude verifying it's authenticity) and Berg claims it is actually a copy of Obama's sister's certificate which has been digitally altered.

Meanwhile, the original records from that hospital have been sealed (for some unexplained reason) by the governor of Hawaii, and it will take an act of the court to reclaim them.

So is Biden, Pelosi, and Harry. I've been a licensed dealer for the last 15 years. Part time kitchen table gun runners is how the Clintons referred to us. Business will be booming for the next couple of months due to the consequences that will come with the election results. I've already stocked up for myself with guns and ammo over the last few years so I'm well prepared for the stripping of our second ammendment rights. Better hurry and buy now.

you can t hank your lucky stars that they didnt get 60 in the senate. Thats the same situation that the Reps were in when they had majority in house and senate. Without 60 votes you can not invoke clouture, and there fore can filibuster forever.
