Dirtbag update, again

Dirtbag's sentencing was today. His attorney claimed that they needed more time to go over the pre-sentence investigation and medical eval. Judge smiled and said "take your time" let's take a short recess. After a couple of minor objections Dirtbag got to address the Judge. He blamed everything on drugs, claimed to have seen the light and wanted to go straight. He did not want his kids to have to grow up with the embarassament of explaining that their dad was in prison and that he wanted to be a good father. He claimed to take full responsibility and wanted to pay everyone back and was very sorry for what he had done to Kate (my daughter)

Kate's turn. She blasted him. Said that he destroyed her faith and trust in people, caused a nervous breakdown that cost us over $2000 in lost fees from Idaho State University when she had to pull out of the semester. She also doubted the drug excuse claiming that he was intent every second and that as far as she knew he did not start drugs until after she went to the police. She said that she just wanted to pay her bills and not be hounded to pay his anymore.

Prosecutor recommended 6 months in a state psychiatric facility with structured probation and an order for restitution. (At $500 per month he would be paying that off for seven years!)

The Judge unloaded on him and sentenced him to 14 years. 4 fixed and 10 indeterminate. The Judge asked for a total of all of the financial damage Dirtbag caused and will order that restitution will follow incarceration. It is going to take Dirtbag a long time to pay off $42,000.

Chase Bank forgave Kate of $15,260, Captiol One forgave $800 and we are still waiting for CitiFinancial, that one is over $16,000.

At least we are getting close and Dirtbag is getting his just rewards.

Thanks for the update Idaho. I have prayed for that situation. It still really fries my ham when I think about it too much. Glad to see the start of resolution for you and your daughter.

WOW!!! Thank God for a Judge with a Clue!!!!! I know it's far from over...and of little consiquence for all your daughter has been through, but at least the Judge isn't buying into this POS' bull sh*t!!! Thanks for keep us informed.... I do think about this from time to time and certainly wish for the best outcome possible!!! So Far...So Good.... Keep the faith Brother!! I'm sure your daughter is pulling from your strength also!!

Like the others...I'm glad the judge didn't just slap his hand!! Also glad to hear the credit card people are giving some of her money back!! Good luck on the last one!

Its good to see a judge not buy into all that "oh poor me b/s". He is not the victim,he is the perpetrator, and I'm glad he is getting his just rewards.

I apologize. I don"t know the details of this story, but I am really glad to hear it"s beginning to work out. I just wish more Dirtbags get the same treatment in court.

The police in these parts like this particular Judge. The irony is that his defense attny disqualified another Judge and was assigned this one. brilliant defense strategy. NOT.
