Looks like you can't protect your home anymore

Just read this article and have to wonder.

Myself, I know for sure that if someone broke in to my house and my wife and/or I was in fear they would not leave the property. They would be put in to the meat grinder and fed to the dogs.

This happened about an hour from my house and I have been following this story closely. He did indeed shoot both teens and after they were wounded and rendered helpless delivered kill shots under the chin. In MN you are allowed to defend your property with deadly force, but apparently the jury thought he went too far. If he had killed them with the first shot he would not have been charged. If I was on the jury he would have walked.

I agree to the fact that he had the right to defend himself, but I think he did an overkill with the finishing shots.

The story in the Chicago paper tells very little of the entire story. I believe Smith is guilty of manslaughter but certainly not 1st degree murder.

I am a firm believer in the right to defend oneself, but this guy killed the burglars in cold blood. He deserves to sit in prison.

The intruders were down and he still feared for his life?
He was so scared he got close enough to put a bullet in their head from under their chin?
I agree with Ponch, this guy is batshit crazy and if that is not murder I don't know what is.
I am all for the 2nd Amendment and the right to self defense but if I were on the jury he would be convicted of first-degree murder.

Way to many variables to know why he reacted like he did. He had been victimized before and firearms were stolen? Not an excuse, but did he really KNOW they weren't armed? Maybe he was frustrated with the situation and just snapped. Still not an excuse but maybe could have plead temporary insanity. The prosecutor went for the kill and the defense jumped out of a crackerjack box with this one imo.

Nick Brady's mother stated that her son died a horrible death and that she often wonders what her son would have been?

He would have been a burglar and a thief. Possibly a killer had he continued to get away with his crimes. Most likely didn't get dead committing his FIRST burglary.

Cactusjack. In what way would you consider this situation a case of entrapment by the gun wielding homeowner? Or were you quoting the article. I'm not calling you out , just would like to hear a little more explanation behind your statement.

Just from what I heard on the news the other day, the old guy was apparently waiting for them. He did everything but invite them inside. It's too bad he had been victimized before, but he shot two unarmed burglars, wounding them - then he executed them. Like I said, I'm no bleeding heart, but I feel the guy got what he deserved in this case.
