Sounds like the typical pre-trial crap that goes on. He and his lawyers know his arse is grass and they are trying to get something "better" for him. Hopefully the prosecuters don't back down and let him off with a slap on the wrist. He has a alcohol abuse history, they have witnesses about his driving that day and they have the blood alcohol levels and noone else in the vehicle to claim they were driving.

This makes me sick. I see no difference between what this kid did than if he pulled a gun out and shot four people at random. The death penalty would be too kind.

This kind of thing is so wrong. No plea deals of any kind, the man was so far over the limit there should be no question of guilt.

"Lefler filed a motion Dec. 29 asking that the alcohol test results and any statements made by Schlichtemeier to investigators be suppressed because his client “was not competent to voluntarily waive any of his rights.”

In other words he was too drunk to understand when the police were reading him his rights. That's pretty much an admission of guilt right there in my books!

I could never be a lawyer:

<blockquote>"Lefler filed a motion Dec. 29 asking that the alcohol test results and any statements made by Schlichtemeier to investigators be suppressed because his client “was not competent to voluntarily waive any of his rights.”</blockquote>

So, let me understand. You shouldn't be able to use the evidence because my client was too drunk to know he didn't have to cooperate?

Is this the classic, "Please grant mercy to my client who killed his parents. He is, after all, an orphan!"

You took the words right out of my mouth. Not competent enough to voluntarily waive his rights, but competent enough to be driving that truck. What a load of crap.

The problem is not only with defense attorneys, but also with the DA's or ADA's. A DA / ADA will offer a plea deal as often as they can, just to get the case over with. They look at their case records as a boxer does, so many "wins" to "loses". Made me sick listening to them when they would decide if they would press charges or not, because they didn't "know if they could win".
Sorry, never agreed with that. I didn't care about "their win/lose record", let the jury decide, that's why we supposedly have a justice system the way we do. I always cared about the victims.

i have to weigh in. I have prosecuted for over 25 years. This has been in federal court, miitary court and in my home state (NC).

First and foremost this clown is a real POS. He does in my opinion deserve the same fate as his victims.

that said, i also sincerely hope he is tried straight up. In my experiencethough i have never encountered an ADA to scared or lazy to try a case out. I have had dockets where i had 100 plus cases to handle in a day. Pleaing is unfortunately a fact of life in some cases.

Lets hope they plea out lesser cases and hold his feet ( and all other body parts ) to the fire.

thanks for hearing me out.
