Pappy is right. These things never pan out and if they do it is for pennies on the dollar. Meantime the targeted company has to fight the lawsuit which it passes onto the rest of us via higher prices.

Mine came in the mail today and I am going to opt out. Don't just throw it away. If you dissagree then you need to write to the address on the last page to opt out otherwise you are in by default. Aren't class actions fun?

Personanly I don't care one way or the other but I wonder if I will get a letter as I have an '07 but purchased it NEW 8-09!

It sounds like a big waste of time, but its keeping the lawyers happy. They are the only ones that will see this as something worthwhile.

Today is February 22nd, not March 22nd. You're pushing the calendar ahead by a month if I read your post correctly.

EDIT: I also noticed that someone else noticed this lawsuit was from Illinois... the "Great State of Obama" and all of the most corrupt politicians on earth... or at least nearly so.

The last figure I looked at... there are so many attorneys in Illinois that the average salary for a "lawyer" in Illinois is $18,000 -- so no wonder they are digging-up such nonsense lawsuits. ;)

I got mine today too. Big deal. Since my speedometer runs a bit fast, I have been driving slower than maybe I should have been going faster and maybe I was going slower but I know one thing for sure....... I was cool. BnG

Got mine today in the mail. Interesting..

Under II: Descripton of the Litigation I found that interesting. We all have mentioned at to how out speedometers could be 10% off and the ODO be 5 % off. I'm not saying anything about money being due but Kawasaki is going to have to answer to claim as to how their speedometers work. Odometers are usually driven by the Speedometer reading. If MaKaw uses a device usurping this it would be interesting for them to answer.

this could be a good reason for all manufactures to make a speedometer and odometer accurate from the get go and not use highly optimistic guages.

The damages requested is "actual damages" or $1500 per owner which ever is greater.

If you read the lawsuit, it says kawasaki put something in the odometer to purposely make it read wrong, or something to that effect. I'd like to see that proof.

I don't know if I will opt out, but the suit is rubbish.

Well if it is the "greater of"... then now a Nomad owner could stand to be awarded $1,500!!! ;) Not exactly "chump-change" we're talking about here.

This is going to be expensive for MaKaw if that is what this settles for.

(Has anyone else noticed an unusual increase in "complications" for Japanese manufacturers that sell products in the U.S. lately? ...or has it just been a coincidence relative to "other" issues here? ???)

If you went to Ma Kaw and tranferred the owner info into your name then you should get one. I am the 2nd owner and did the transfer at the dealer. To get warranty, recall, and class action lawsuit info.

I received my notice today as well. My odometer adds more miles than driven as compared to my gps. There has been some debate whether the speedo is related to the odo on the bikes. Some say their speedo is correct and the odo is off. Some say the speedo is off and the odo is correct. I am in the class that both are off. Oh well. I'll supersize my burger meal if/when the check arrives.
