Can somebody use your Nomad picture for ebay?

Thanks to a VERY kind person here, I discovered that a seller is using one of my pictures with both my 900 and hubby's Nomad in it!!!! He is selling the top rails for Kawasaki....the ones on Chaz's bikes are NOT for Kawasaki!!!! So, this is misleading to a buyer!!!! Then, he has watermarked HIS username in the picture for his auction. Can he do this? After all, I have posted that picture in here openly before....

The acution number is 170456165021 (he has more than one)

Okay, I'm thinking that since he is using this picture for monetary gain, he should have been given permission first. Am I thinking along the right track?????

Do everyone a favor and let Ebay know of a possible fraud situation.

Just because he used your picture does not mean this guy IS a fraud... however it would be best to "rattle his cage" somewhat.

Regarding your question on a picture...

...you posted the picture in a public domain... therefore one can copy and use the picture freely. You truely have no rights to it unless you copyrighted your picture -- which most professional photographers; magazines, and other such sources do to protect their rights to their property.

Sorry; but you have no recourse on this matter.

However... if this person is falsely advertising something... you need to notify Ebay about it. It would do someone a big favor.

First, let me say that I am not a lawyer, but since you posted these online without any type of copyright notice (or application for copyright) and no effort was made to password protect them, then they are likely considered to be public domain in a legal sense. If you were in the picture then he would need a "model's" consent to use for commercial purpose.
You could report this to ebay since this would be misleading to someone buying these if they don't accurately represent the product he is selling. Perhaps they might contact the seller. You could post a question or comment on his auction, but I would be a bit cautious about saying anything nasty where others can read it.

You could always just accept this as flattering. :)

Okay, thanks gang!!! I have just never had somebody use one of my pictures for ebay!!! LOL! You're right, I should just be flattered. However, those racks on our Nad really aren't Kawasaki racks....they are Yamaha!!!

The seller states they are aftermarket racks, his racks fit the Nomads, and your racks are shown for display purposes. Your Yamaha racks look really good on your bikes. To me the end result is the same, nice chrome racks on Nomad bags.

In my opinion while this gentleman may be a legitimate ebay business man, by using these pictures he is implying that they are actual photos of his product installed on these bikes. I think contacting ebay and voicing your concerns would be my first step.

I can't tell they are not made for Nomads.. Look like my fire and steel to me. The other guys are right about copy right. The only copyrighted material I have is my avatar which is my wife's original art. Since there is no water mark there isn't much I can do if I see it on line, but laff at what ever tale that person might have, and then prove him wrong with the rest of the original art.

Now if I see it face to face in paint, somebody could have a bad day.

Twice in paint on ME I found I had been commericalized... Once as a warrior poster in the town of Ticonderga, and at the fort with another image near my lodge cleaning my musket with a friend uniform cleaning his musket as a post card.

Another friend of mine working for the fort BOUGHT the post card for me as a gift LOL. So like you I got used for gain and can't do a bloomin thing about it. But there is nothing stopping me from using that fort with my own image and any friends to make post cards.

I don't believe it is legal to use a picture of someone elses bike or whatever they are selling. I would notify eBay about it. They have a fraud link you might want to check out.

I checked out the site and one of the photos shows a license number "YA BUM". Maybe that's what the seller is???

If there is a lic plate showing then E-Bay should be notified and the pic removed.

Not just your bike. He's shows another guy that is on here who make a vulcan 2000 into a Nomad. The rail are definitely not his because the guy made the rails and bags deeper. He has the VN2000 listed as a Nomad 1500...

I cut and pasted the auction number and can find no pictures of any motorcycles.
