1st amendment infringement and then some
Now I don't condone or support the activities alleged in the government's prosecution of this organization, however if the news story is accurate and the order of the court is not overturned, a big bite just got taken out of our free speech protection.

Yikes LW, of course I'm annoyed more than most about losing rights, so that rubs me all kinds of wrong.
__________________________________________________ _________________ Observers questioned whether the injunction is constitutional. "Here you have the government stepping in and preventing a rights holder of using the (trade) mark they legally obtained," said attorney Douglas Mirell, who specializes in First Amendment cases. "It strikes me as a serious potential First Amendment violation to have the government come in and attempt to, and in this case exceed, stripping lawfully obtained rights," he added. "This is one for the record books." __________________________________________________ _________________________ And it give the government the right to take your vehicle, just because it doesn't like the emblem you put on it. An emblem that you have the trade mark to, no less. __________________________________________________ __________________ The Marshal's Service is guarding 60 motorcycles, almost all of them Harley-Davidsons, that were seized during Tuesday's operation. Burke estimated the average value of the customized machines to be $22,000. __________________________________________________ ___________________ Our present government is going crazy with taking rights away. If the whole time machine thing worked, I'd hope for a bunch of the founding fathers to came back and set things straight. The government is spying on our Internet usage, so I'm already on a list probably, but even a statement like that one will probably get me flagged somehow. Piss on em. |

I would think that if the clubs treasury is frozen, there will likely be several lawyers that will provide Pro Bono services. I see a long battle ahead (And lots of taxpayers $$$$$$$$$$$$$$ wasted) The word and the logo did not break the law, if any were broken.

This is one reason I will ALAWAYS vote NO on ALL judge re-elections. Leave a judge in too long and they start to think they are God.

They did something very similar here also a few months ago, A chapter of the Hells Angels had there assets seized and the clubhouse as well. The house was sold recently by auction. I don't agree with the way the government is handling these situations also.
