Again. Texting?

One of my co-workers, who knows an Oro Valley police officer, informed me today the the driver of the truck was texting at the time of the accident. Rumor is the truck drive may be charged with manslaughter. I can not confirm this, but will provide more details if I get them.

I hope they do charge the driver with manslaughter, just like the guy in Phoenix that took out those 10 bikes and was just found guilty last week.

Saw on the local news last night about an accident involving a motorcycle and an auto. Obviously the biker was killed. They stated the driver was charged with murder. They didn't give any details as it was breaking news. Didn't even give the persons name that got killed. Waiting on notification of next of kin. Never heard of someone being charged with murder unless he shot the guy. Will try to let you know when I find out more.

Cell phone use is still way to common on the roads. Thats something I'd like to see enforced a lot stricter.

Idaho passed a texting law this year and I think it is good thing. There will always be those who don't care and do it anyway but it has cut waaaay down on the incidence of texting. You can't even text at a stoplight in this state.

As to the driver in Az who did this,,,,,,,prison. period.

My opinion is that cell phone use should be illegal while driving. Period. It's illegal to text while driving in the city of Phoenix now, but legal in the rest of the greater Phoenix area.

I'll admit I used to text while driving then I took up riding again and realized what a hazard it presents to others on the road. Now I won't even answer calls on my cell while driving unless it's work-related and I am on-call. I am constantly telling my wife to leave the cell in her purse while she's driving.

Good, for some reason Ive noticed that women seem to be a lot more prevelant with using them than men. At least thats what I see when I'm on the road. Even though its against the law here, it doesn't seem to slow down too many people from using them.

The main difference between murder and manslaughter is intent or malice. Tough to prove murder in an auto "accident" (although obviously not impossible). If someone is charged with murder while driving, the prosecutor is generally posturing, hoping the defendant will opt for a plea to a lesser charge (like manslaughter oddly enough) since there's always the remote possibility that the defendant will get convicted of murder.
