Joel has a major point here. When we start holding the seller of alcohol to folks who are obviously drunk we will have taken a major steep in reducing DUIs incidents. In some states (CA is one), it is in fact a crime to sell alcohol to a person who is obviously drunk. So, not only can the seller lose big $$$$s but they can also go to jail.

Where I came from this was called a Dram Shop Law. Dram shop Laws go back to the end of Prohibition. Whether of not if the bartender or retail clerk suspects that the customer is drunk the establishment is libel for any damages that may occur as a result of that liquer sale.

Dram Shop Insurance is a big cost of every drink or package liquer sold.
Years ago my neighborhood (all the participating homeowners) bought Dram Shop Insurance to cover a block party. This is pretty common in the Midwest.
