well thanks anyways mbarr10. even tho the answer sucks, at least we now know how it works. I still have 2 years of warranty left, so I will leave it as is for this year and maybe bite the bullet and get it flashed next year. my bike just turned 20,000klms. and the motor is quiet and runs strong so if it hasn`t blown up by next year then it must be a good one and warranty be dammed!!

Remember that Kawi has to prove the ECU being flashed was the cause of any failure to deny it. There could be many things that cause an engine failure that wouldn't be linked to the ECU.
I am hoping to buy a used stock ECU but if I had a massive engine failure I would just have the bike towed to my home and then purchase a new ECU to install before I would take it to the dealer. I shouldn't have to do that because my dealer is fine with the flash. It would only be a problem if I was on an extended trip.
