Can you believe this crap?!?!

I FINALLY got my bike out of the shop yesterday morning from being repaired from the guy who hit me 3 weeks prior and I'll be DAMNED if I didn't get rear-ended yesterday evening! AARRRGGGHHH! Here's what happened:

I was turning left into a restaurant parking lot and waiting for a truck to exit the parking lot on a two lane road. The car that was following me right before I stopped, also stopped with me. Then all of a sudden, BAM he hit me (and it was a really hard hit). He said he looked off to the left and wasn't paying attention and then took off. The bike is actually rideable, but the rear fender is bent all to hell and I think the right saddlebag is bent as well. I'm going to the kawa dealership in just a minute to get an estimate and see what damages there really are.

It was all I could do not to go postal on this guy! Do I have a sign that says hit me?

I owned a Trans Am back in 77, I was hit three times with it within a couple months, and I was sitting still all three times. I sold the car!

Had similar luck with my first car as you Ring. However, my car was hit 3 times and it was parked and I wasn't in it.

That ain't a bad idea. I have a gremlin bell on it from my other bike. Maybe someone should give me a new one as well.

Wow, that is bad luck. A number of years back I got hit twice in my pick up by guys on bicycles at different locations. Both times I was stopped waiting for the cyclist to pass before exiting a parking lot onto the street. Both times instead of going straight they swerved into the parking lot hit my front bumper and did a face plant on my windshield. Neither one was hurt much, but the truck got the hood repainted each time. I was a little pissed off by the second time and when the cyclist ( he was not a kid ) said he didn't see me, I said no shit sherlock, your riding a ten speed with racing handlebars and wearing a base ball cap. We had words after that, but his house insurance did pay for my damages.

Lol. No doubt! I'm usually ride lead but who knows now!

It's funny to that when I called his agent and spoke to the secretary, she asked who it was and when I told her, she said "holy cow, that's my brother!"

Were you lined up with the driver's side of the car that was behind you?

Do you have extra lighting on your bike?

Do you have a bright colored helmet and/or wearing a Hi Viz Vest?

Do you have a lawyer on speed dial?

The last time I was hit (26 year ago) I was sitting still.

The two times I was almost hit since then I was sitting still. I try not to sit still anymore.

It wasn't that he did'nt see me, he was following me and stopped when I did. He obviously saw me. But, he looked off to the left for a second and took off without looking back first. I could've been a firetruck with red lights on and he'd of hit it.

Be careful that the $3000 doesn't exceed what the insurance company says it is worth or they will total it on you.

My son got rear ended while in his '97 LeSabre and the adjuster was nice enough to keep the estimate just under "total" value. My son pocketed the money and kept on driving.

Bluebook on the bike is $4,850 (Just looked it up). a difference of $1850. Don't know if they will total the bike or not but I found my fender on ebay for $180 shipped in pristine condition (I bought it) and I don't think the saddle bag is really bent (I think the fender is just pushing it out) but I found my year model/color saddlebag on ebay with some scratches and it's bid right now is $122. I'm gonna take off the saddlebag when I get home and see if it's bent or not because there's only one small scratch on it. If it is, I'll buy the saddlebag as well. The saddle bag has some scratching on it, but only on the door and I can probably use my door on it if need be.

All depends how nice you want to keep your ride. I finally decided to keep the rest of the damage on "Grace". It's not that noticeable and doesn't affect performance. :shrug:

You may find the the saddlebag pops back into shape once its removed from the bike. Its probably the fender pressing on it. If its not cracked, a paint job should fix it right up. I managed to straighten a lot of the parts on my bike that got twisted a bit. The parts that really got damaged Ive been replacing.

The fender is toast. No need to keep it but I think the saddlebag is still good. Even if it is slightly bent, I'll still keep it to sell or something. All I want is the bike back to where it was before the hit and If I can get some extra money to get my fairing painted and get a better trunk (http://recklessmotorcycles.com/index.php?l=product_list&c=74) and have it painted, that'll be great. The trunks gonna run me around $250 and not sure on how much it'll cost to have someone paint fairing and trunk and get the backrest/hinges/lock/chrome for the trunk. Plus I wanna add some more taillights to the trunk and make my taillight and headlights modulate.

That's exactly what I'm thinking. I'm gonna take off the saddlebag tonight and check and see. There's only one small scratch on it.

I would think your personal injury claim :yep: would more then buy you a new bike. While I don't promote needless claims in this case I would have ridden the amblance all the way to the bank!

I wouldn't settle for at least a week. You never know what medical issues could pop up that weren't noticable immediately. Seriously. It's not a scam. Even the honest insurance adjusters will tell you the same thing. Ever banged your shin and didn't realize until later that it ended up bad enough to bleed all down your leg? Same thing. Neck, back, muscular, etc sometimes don't show up. Do NOT take the adjusters first offer (unless he wants to buy you a new VV). At the least, tell him you'll have to think about it and can he get back with you next week. Then do NOT call him. Let him call you. I'm not saying to scam the insurance but if there's something damaged on the bike (from the accident) make sure you document it and put in a claim for it. Even if you just need new paint on your bag. The worst the insurance co can do (at least in Indiana) is total your bike. You can generally buy it back for around 10%. A salvage title on anything more than about 6 or 8 years old really doesn't matter especially if you have pics of the before and after so the next owner knows there wasn't anything major damaged and that you fixed it all. It shouldn't hurt your insurance rates either as it's not your insurance that's paying. (I assume the other party has insurance.)

Don't scam the insurance but get everything you're due even if it's a cut tire (which you should really look for considering where that fender is).

Good idea about waiting to see if there is personal injury. I really doubt it but best to be careful.

When I settled my claim back in the 80s they handled the motorcycle and the injury separately. I was able to close out the motorcycle claim without closing out the injury claim. Of course you have to watch what you are signing. Don't know if they do that these days or not. Since you will be dealing with the other guys insurance, you might want to ask your insurance agent some questions.

I guess they say bad things come in three's Two motorcycle accidents in a month so what could be next? Company told me yesterday they had to downsize and today's my last day :( Back on the job hunt again... Hopefully all the bad stuff is over and done with!

That was very big of them to give you a whole 24 hours notice. I'm sure someone woke up Thursday morning and decided that tomorrow is the day to lay people off. Incredible. Employers complain they can't find good employees, and then they treat them like this.

Same thing after my accident 18 months ago. Settled the bike claim a few days after I got out of the hospital but didn't close the PI claim for almost 3 months. Progressive couldn't have been better to work with.

The PI rider in the bike insurance is the best bargain I've had in a long time. I've got a $3K out of pocket cap on my medical insurance, and the PI paid that plus some lost income and other incidentals. I had almost $110K in medical and my total out of pocket tnded up being the $400 deductable on the PI.

dyetube, Sorry about your job. Lawyer up if you've been hurt. I'm not saying get greedy or dis-honest, just that things (especially medical costs) can change fast. If you accept a quick closing settlement you're done. :ohno:

Patricia and my accident was September 5, 2010. There were a couple of "up front" settlements that took care of the bikes and some of the medical. The rest of the case (including loss of my career) won't even get a court date until December 2012. At this point Patricia and I both have recurring debilitating pain due to the accident. I'm doing well to put in 10 hours of what I used to call work in a week. The rest of the time is what it takes to recover from the pain. (Oxycodone & Tequila help if I stay still) Doctors and Physical therapy got almost all of what we received so far and we're not done yet. We down sized and moved to Phoenix to make things work, but before the accident I wasn't thinking of retirement at 53. The lawyer is willing to work on percentage so won't get paid until there is a settlement. :tup:
